    Abstract: Die digitale Transformation hat tiefgreifende Auswirkungen auf die Geschäftsmodelle und Angebote von Schweizer Unternehmen. Die Produkte werden zunehmend digitaler. Durch die Entwicklung und den Export von digitalen Produkten und Dienstleistungen entstehen für Unternehmen neue Herausforderungen. Der Leitfaden "Exportkontrolle von digitalen Angeboten" veranschaulicht anhand eines Beispielunternehmens die wesentlichen Problemfelder der Exportkontrolle in einer digitalen Wirtschaft. Im Weiteren werden Einflussfaktoren und Massnahmen für eine gesetzeskonforme Exportkontrolle beleuchtet und aufgezeit. Zudem werden Ergebnisse einer umfangreichen Studie zur Exportkontrolle von digitalen Angeboten präsentiert.

    Abstract: Unternehmen müssen einer Vielzahl von Verpflichtungen nachkommen, um sich «compliant» und somit regelkonform zu verhalten. Dazu gehören nicht nur die anwendbaren Rechtsvorschriften und die vertraglichen Verpflichtungen des Unternehmens, sondern auch selbstverpflichtende Normen wie beispielsweise ein unternehmensinterner Verhaltenskodex, interne Weisungen oder auch Kodizes von (Branchen-)Verbänden.  Um diesen hohen Anforderungen gerecht zu werden, investieren Unternehmen regelmässig grosse Summen in «Corporate Compliance». Die konkreten Auswirkungen dieser Investitionen auf den Unternehmenserfolg sind bislang jedoch noch unklar und nicht wissenschaftlich belegt. Höchste Zeit also, diese Forschungslücke zu schliessen. Ein Team von Forschenden befasst sich deshalb in einem von der Innosuisse finanzierten Projekt «Return on Compliance» mit eingangs gestellter Frage.

    Abstract: Seit mehr als zwei Jahrzehnten werden IT-gestützte Instrumente bei Compliance-Untersuchungen eingesetzt. Dabei haben sich der Anwendungsbereich und die Methoden im Laufe der Zeit erheblich verändert. Einerseits nimmt die Menge der zu bearbeitenden Dokumente, Daten und Datentypen massiv zu. Andererseits werden die technischen Methoden zur Datenbearbeitung immer leistungsstärker. Aktuell stellt sich die Frage, inwieweit es möglich ist, durch neue Technologien aus dem Bereich Big Data und künstlicher Intelligenz (KI) Automatisierungspotenziale zu heben, mit denen Compliance-Untersuchungen besser, schneller und kostengünstiger durchgeführt werden können. Dieser Beitrag zeigt den aktuellen Stand in der Praxis sowie Entwicklungspotenziale in der nahen Zukunft auf.

    Abstract: Due to increased public pressure and tightening legal frameworks, companies face the task of ensuring responsible management not only within their own organisations but also in their international supply chains. l Successfully addressing the complex challenges along international supply chains requires all actors involved – first and foremost, companies and their suppliers – to take collective action. This CoAct-Handbook provides large companies as well as small and medium-sized enterprises (SMEs) with tools and methods to ensure responsible management in the various supply chain constellations. For this purpose, a model was developed to classify each buyer-supplier relationship according to the company’s ability to influence the supplier and the risk level associated with the supplier related to environmental, social and governance (ESG) issues. The model shows that each company, even if its respective ability to influence the supplier may differ, is able to take measures for responsible management in the supply chain in each constellation. In addition, options for action take the form of a roadmap and a toolkit.

    Abstract: Aufgrund des erhöhten öffentlichen Drucks und den sich verschärfenden rechtlichen Rahmenbedingungen stehen Unternehmen vor der Aufgabe, verantwortungsvolle Unternehmensführung nicht nur in der eigenen Organisation, sondern auch in ihren internationalen Lieferketten sicherzustellen. Um die komplexen Herausforderungen entlang der internationalen Lieferketten erfolgreich anzugehen, ist kollektives Handeln aller beteiligten Akteure erforderlich, allen voran der Unternehmen und ihrer Lieferanten. Das vorliegende CoAct-Handbuch stellt Grossunternehmen und kleinen und mittleren Unternehmen (KMU) Instrumente und Methoden zur Verfügung, um verantwortungsvolle Unternehmensführung in den unterschiedlichen Lieferkettenkonstellationen sicherzustellen. Dafür wurde ein Modell zur Klassifizierung des Einflussvermögens und des ESG-Risikoniveaus erarbeitet, das aufzeigt, dass jedes Unternehmen, auch wenn sein jeweiliges Einflussvermögen unterschiedlich ist, in jeder Konstellation Massnahmen für eine verantwortungsvolle Zusammenarbeit in der Lieferkette ergreifen kann. Zudem wurden Handlungsoptionen in Form einer Roadmap und eines Methodenkoffers entwickelt.

    Abstract: Clients may feel trapped into sharing their private digital data with insurance companies to get a desired insurance product or premium. However, private insurance must collect some data to offer products and premiums appropriate to the client’s level of risk. This situation creates tension between the value of privacy and common insurance business practice. We argue for three main claims: first, coercion to share private data with insurers is pro tanto wrong because it violates the autonomous choice of a privacy-valuing client. Second, we maintain that irrespective of being coerced, the choice of accepting digital surveillance by insurers makes it harder for the client to protect his or her autonomy (and to act spontaneously and authentically). The violation of autonomy also makes coercing customers into digital surveillance pro tanto morally wrong. Third, having identified an economically plausible process involving no direct coercion by insurers, leading to the adoption of digital surveillance, we argue that such an outcome generates further threats against autonomy. This threat provides individuals with a pro tanto reason to prevent this process. We highlight the freedom dilemma faced by regulators who aim to prevent this outcome by constraining market freedoms and argue for the need for further moral and empirical research on this question.

    Abstract: Corruption continues to be a considerable challenge for internationally active companies. In this article, we examine personal and socioenvironmental antecedents of corrupt behavior in organizations. In particular, we aim to illuminate the links between Machiavellianism, on-the-job experience with corrupt behavior at work, neutralization, and the attitude of business professionals toward corruption. The empirical analysis is based on the responses of 169 professionals. At first, a positive relationship between both Machiavellianism and on-the-job experience and the acceptance of corruption appears in the model. However, an in-depth mediation analysis shows that neutralization is the keystone linking both Machiavellianism and on-the-job experience to the likelihood to condone corruption. Based on these results, we offer avenues for further research and implications for practitioners.

    Abstract: Risks, which could jeopardize the integrity of a company, are widespread. This holds true for firms located in Switzerland too. According to a recent study by PricewaterhouseCoopers (2018), almost 40 percent of Swiss companies have been affected by illegal and unethical behavior, such as embezzlement, cybercrime, intellectual property infringements, corruption, fraud, money laundering, and anti-competitive agreements. Although the number of cases in Switzerland is relatively low when compared to other countries globally, the financial damage for affected Swiss companies caused by these incidents is nevertheless above the global average.

    Abstract: Integre Unternehmensführung hat in den vergangenen Jahren national und international an Bedeutung gewonnen. So thematisiert die Wirtschaftspresse immer wieder das Verhalten von Unternehmen, die ihrer unternehmerischen Verantwortung nicht gerecht werden. Zugleich verlangen verschiedene Anspruchsgruppen von den Unternehmen mehr Transparenz bzgl. ihrer Aktivitäten. Dies veranlasst die Unternehmen in ihrer nicht-finanziellen Geschäftsberichterstattung über ihre Bemühungen um integres Geschäftsgebaren in den Bereichen Menschenrechte, Umwelt und Anti-Korruption zu berichten. Im Rahmen des Forschungsprojekts Integry Risk Monitor (IRM) wurden das IRM-Portal und das IRM-Dashboard entwickelt. Hierbei handelt es sich um webbasierte Echtzeit-Monitoring-Instrumente. Das IRM-Portal umfasst Medienbeiträge der letzten 25 Jahre aus unterschiedlichen Quellen. Ferner durchforstet der Algorithmus permanent das World Wide Web und sammelt neue Beiträge aus redaktionellen Medien. Diese können mithilfe des IRM-Dashboards mit verschiedenen Analyse- und Darstellungsmöglichkeiten untersucht und Zusammenhänge, Beteiligte, Sentiments und geografische Hauptregionen ermittelt werden. Zudem wurde im Rahmen des Projektes auch die nicht-finanzielle Geschäftsberichterstattung von Unternehmen untersucht, um Beziehungen zwischen der medialen und nicht-finanziellen Berichterstattung zu analysieren. Die Ergebnisse der Untersuchung machen deutlich, dass sowohl die Medien als auch die analysierten Unternehmen in den letzten 25 Jahren mehr über die Themen Menschenrechte, Umwelt und Korruption berichten, vorderhand jedoch kein direkter linearer Zusammenhang zwischen diesen beiden Formen der Berichterstattung besteht.

    Abstract: Purpose: This paper aims to propose a framework to map partnerships as practiced in higher education institutions (HEIs) and trace the current mode of engagement between HEIs and their partners. This paper reflects on the alignment between current practices and what is understood in the literature as “true” partnerships. We are interested in the different modes of engagement that are labeled by the HEIs as partnerships and consider the plasticity of the term. The interest is in how the term is operationalized by HEIs and how variations in approach can be accounted for while still maintaining some stability and common understanding of the term partnership. Design/methodology/approach: Drawing on extant literature in the field of cross-sector partnerships, a three-dimensional framework is proposed to map partnerships as practiced in HEIs. Furthermore, this paper draws on insights gained from the partnership stories of 13 leading principles of responsible management education (PRME) signatories to evidence examples of how this framework can help us to categorize the different types of engagement that the HEIs call partnerships. These case stories were gathered in the fall of 2019, based on a brief inquiry form sent to the 39 PRME signatories who were part of the PRME Champions Cycle 2018–2019. Findings: This paper sees cases where faculty drive interaction on sustainable development goal-related issues with external stakeholders, but where the impact of these interactions seems to reside within the main business of the HEI (teaching and research). In contrast, much partnering work addresses broader social impacts. Of particular, interest in partnerships that seek to address a specific local issue, first and foremost and doing so in such a way as to apply the unique resources of the HEI working in multi-stakeholder networks. This paper also notes important variation between individual faculty-driven initiatives and initiatives where the school provides a strategic framework to support these efforts. Research limitations/implications: By focusing on the academic sector and its stakeholder partnerships, this paper contributes to the literature on cross-sector partnerships. In particular, the specifics of this context and the importance of, for example, academic freedom have been under-researched in this field. Furthermore, the framework presented is novel in that it helps us to grasp the nuances of external university partnerships that can form out of individual, programmatic and other institutional levels. Practical implications: From a practice perspective, the framework offers a useable tool for HEI partnership managers to position themselves and their activities and reflect more on how they organize external partnerships. Further, this tool offers a more precise framework for the discussion on partnerships within the PRME to sharpen the partnership instrument and bring more clarity about what is meant by the partnership for the goals. Originality/value: The paper offers a novel partnership portfolio framework that contributes both to theory and practice. The framework aids in mapping the locus of benefits/outcomes and the material and affective commitments made by the HEI to bring these collaborations about. In dimensionalizing partnerships in this way, this paper can conceptualize a balanced portfolio in an HEI’s partnerships for the goals.

    Abstract: In recent years, trade-control laws and regulations such as embargoes and sanctions have gained importance. However, there is limited empirical research on the ways in which small- and medium-sized enterprises (SMEs) respond to such coercive economic measures. Building on the literature on organizational responses to external demands and behavioral ethics, this study addresses this issue to better understand how external pressures and managerial decision-making are associated with the scope of trade-control compliance programs. Based on a sample of 289 SMEs, the findings show that the organizational responses of SMEs reflect proportionate adjustments to regulatory pressures but only if decision-makers are well informed and aware of the prevailing rules and regulations. Conversely, uninformed decision-making leads to a disproportionate response resulting in an inadequately reduced scope of the compliance program. In addition, the results indicate that SMEs that are highly integrated into supply chains are susceptible to passing-the-buck behavior.

One such organizational control discussed in the literature is whistleblowing, which is often described as an effective measure to combat serious corporate misconduct. The extant whistleblowing literature focuses mainly on the individual informant, while less attention has been paid to the formal structures – i.e., whistleblowing channels – set up by organizations to facilitate whistleblowing. Drawing on expectancy theory, this study examines the ability of different types of reporting channels to safeguard the anonymity of whistleblowers. Based on a survey covering 178 organizations from France, Germany, the United Kingdom and Switzerland, this study shows that a web-based reporting system is more effective in protecting whistleblowers’ identities than conventional reporting channels. It thus demonstrates that ICT-based tools can play an important role in the fight against corrupt behavior against or on behalf of MNCs.

    Abstract: Concerns for responsible business practice have increased in the wake of supply chain scandals. Consequently, companies are increasingly held accountable not only for irresponsible business conduct within their own organisation but also by supply chain partners. In this light, companies implement controls to safeguard responsible business conduct within their international supply chain. Extant literature looks extensively at internal controls in isolation, with less of a focus on how supply chain partners can interact to ensure responsibility. Moreover, literature on the topic pays little attention to the organisational differences between small and medium size enterprises (SMEs) and their larger counterparts. Rather, extent literature places a heavy emphasis on formal controls favoured by large enterprises and tends to overlook the informal approaches taken by SMEs. With this in mind, the aim of the present paper is to propose a qualitative inductive framework based on contingency theory, illustrating how SMEs’ and larger companies’ responsibility-related control systems are organised. Based on the model, it becomes evident why the approaches used by SMEs and LEs to implement, promote and ensure responsible management throughout the international supply chain are often incompatible in practice and lead to conflicts.

    Abstract: Despite the increasing inclusion of ethics and compliance issues in corporate training, the business world remains rife with breaches of responsible management conduct. This situation indicates a knowledge–practice gap among professionals, i.e., a discrepancy between their knowledge of responsible management principles and their behavior in day-to-day business life. With this in mind, this paper addresses the formative, developmental question of how companies’ ethics and compliance training programs should be organized in a manner that enhances their potential to be effective. Drawing on both the qualitative analysis of existing ethics and compliance training and the conceptual literature on behavioral ethics, a framework is proposed that consecutively aligns various types of training into a comprehensive ethics and compliance training program. The strengths and limitations of the suggested framework are discussed.

    Abstract: A substantial number of international corporations have been affected by corruption. The research presented in this paper introduces the Integrity Risks Monitor, an analytics dashboard that applies Web Intelligence and Deep Learning to english and german-speaking documents for the task of (i) tracking and visualizing past corruption management gaps and their respective impacts, (ii) understanding present and past integrity issues, (iii) supporting companies in analyzing news media for identifying and mitigating integrity risks. Afterwards, we discuss the design, implementation, training and evaluation of classification components capable of identifying English documents covering the integrity topic of corruption. Domain experts created a gold standard dataset compiled from Anglo-American media coverage on corruption cases that has been used for training and evaluating the classifier. The experiments performed to evaluate the classifiers draw upon popular algorithms used for text classification such as Naïve Bayes, Support Vector Machines (SVM) and Deep Learning architectures (LSTM, BiLSTM, CNN) that draw upon different word embeddings and document representations. They also demonstrate that although classical machine learning approaches such as Naïve Bayes struggle with the diversity of the media coverage on corruption, state-of-the art Deep Learning models perform sufficiently well in the project's context.

    Abstract: Business applications relying on processing of large amounts of heterogeneous data (Big Data) are considered to be key drivers of innovation in the digital economy. However, these applications also pose ethical issues that may undermine the credibility of data-driven businesses. In our contribution, we discuss ethical problems that are associated with Big Data such as: How are core values like autonomy, privacy, and solidarity affected in a Big Data world? Are some data a public good? Or: Are we obliged to divulge personal data to a certain degree in order to make the society more secure or more efficient? We answer those questions by first outlining the ethical topics that are discussed in the scientific literature and the lay media using a bibliometric approach. Second, referring to the results of expert interviews and workshops with practitioners, we identify core norms and values affected by Big Data applications—autonomy, equality, fairness, freedom, privacy, property-rights, solidarity, and transparency—and outline how they are exemplified in examples of Big Data consumer applications, for example, in terms of informational self-determination, non-discrimination, or free opinion formation. Based on use cases such as personalized advertising, individual pricing, or credit risk management we discuss the process of balancing such values in order to identify legitimate, questionable, and unacceptable Big Data applications from an ethics point of view. We close with recommendations on how practitioners working in applied data science can deal with ethical issues of Big Data.

    Abstract: In den vergangenen Jahren kam es im organisationalen Feld von Unternehmen bezüglich Auslandskorruption zu einem politisch-juristischen Paradigmenwechsel. Basierend auf der Neoinstitutionalistischen Organisationstheorie analysiert der vorliegende Beitrag über welche inhaltlichen Aspekte ihrer Anti-Korruptions-Compliance börsennotierte Unternehmen aus Deutschland und Frankreich berichten und ob sich die Unternehmen bzgl. des Umfangs der von ihnen kommunizierten Anti-Korruptions-Compliance ähneln. Ferner wird untersucht ob sich bzgl. Umfang und Inhalt der kommunizierten Anti-Korruptions-Compliance Unterschiede zwischen den deutschen und französischen Unternehmen zeigen. Die Untersuchung erfolgt mittels computergestützter Inhaltsanalyse der relevanten Publikationen von börsennotierten Unternehmen mit Sitz in Deutschland und Frankreich. Die Ergebnisse machen deutlich, dass in Frankreich eine gewisse Homogenität bzgl. Inhalt und Umfang der kommunizierten Anti-Korruptions-Compliance besteht. In Deutschland und über beide Länder betrachtet scheinen die Mechanismen Zwang, Nachahmung und normativer Druck jedoch unterschiedlich auf die Unternehmen zu wirken, sodass der derzeitige Grad an Homogenität als relativ gering einzustufen ist.

    Abstract: Corruption continues to represent a tenacious challenge to internationally active companies. According to prevailing international anti-corruption standards, a company can be held criminally liable if it does not put all necessary and reasonable organizational measures in place to prevent corruption. The regular training of employees is considered one of the most effective ways to prevent corruption. Employee training is considered helpful in efforts to minimize the risk of employees becoming involved in corrupt behavior. With this idea in mind and building on the fraud triangle model and neutralization theory, this paper examines whether business professionals who have undergone anti-corruption training are more likely to reject prevailing justifications of corrupt practices than are those who have not undergone such training. The empirical analysis in this paper is based on regression models using data obtained from a unique dataset that includes 200 business professionals. The findings provide evidence that training is positively linked to the likelihood of rejecting justifications of corruption. However, the research also suggests that methods of training must become more specific in order to tackle challenging questions regarding the gray areas of ethics and compliance.

    Abstract: In den letzten Jahren haben handelspolitische Zwangsmassnahmen wie Embargos und Sanktionen an Bedeutung gewonnen. Um sich regelkonform zu verhalten, muss jedes Unternehmen die mit seiner Geschäftstätigkeit verbundenen Beschränkungen kennen und überwachen. Eine Studie der HTW Chur untersucht, wie Unternehmen mit ihren handelskontrollrechtlichen Pflichten umgehen. Basierend auf einer Stichprobe von 289 Schweizer KMU, zeigen die Ergebnisse, dass gut die Hälfte der befragten KMU von Vorschriften der Handelskontrolle betroffen sind, aber viele das Thema unterschätzen. Dies macht deutlich, dass die Unternehmen dem Thema Trade-Compliance ein höheres Gewicht beimessen müssen. Zudem sollten die zuständigen Behörden den KMU angemessene und leicht zugängliche Informationen anbieten. Und die Selbstverwaltungsorganisationen der Wirtschaft sollten ihre Sensibilisierungsaktivitäten zum Thema Handelskontrolle intensivieren.

    Abstract: Purpose Corruption continues to ravage societies around the world. The fight against corruption can be fruitful only if approached from multiple standpoints. Thus, corruption must also be approached from an academic and educational perspective. The purpose of this paper is to provide a good practice example of how universities and business schools can take actions to align themselves with the international sustainability and anticorruption agenda. Design/methodology/approach The six principles of the United Nations Principles for Responsible Management Education (PRME) provide a framework for higher education institutions to address corruption-related issues. This paper presents the case story of the Swiss-based University of Applied Sciences HTW Chur, which developed an academic working agenda on corruption-related topics based on the principles of the PRME. Findings The case story shares the actions that HTW Chur has taken and the benefits that have resulted from the university’s work. The findings show that to address corruption-related issues, scholars from the university took actions related to four principles in the PRME: method, research, partnership and dialogue. Furthermore, the results indicate that in addition to the university itself, public and private institutions have also profited from the actions taken. Research limitations/implications This paper is founded on a single case story; thus, the usual limitations of this research design apply. Practical implications It becomes apparent that the needs of the private sector in the fight against corruption could be addressed by engaging in and strengthening partnerships with universities. Thus, it seems beneficial to develop guidelines and standards to facilitate collaborations and dialogue in a participatory and transparent way. Originality/value The paper provides a good practice example of how universities can take actions to align themselves with the international sustainability and anticorruption agenda.

    Abstract: Recent organization and management literature started to address the relation between (1) organizing corporate social responsibility (CSR) and (2) fighting corruption. However, it appears surprising that these two phenomena have been long discussed in isolation considering that anti-corruption is typically regarded as a part of CSR; see, for example, global sustainability initiatives like the UN Global Compact. Firm size seems to importantly moderate this relationship. Previous CSR literature suggests that small and medium-sized enterprises (SMEs) have a CSR communication gap, whereas large firms have a CSR implementation gap. That means, the former implement rather than communicate CSR while the latter communicate rather than implement CSR. Corruption scholars challenge the assumption that SMEs are necessarily better anti-corruption implementers. We aim to help solve this puzzle by empirically investigating the relation between CSR and corruption at small and large firms. We build on a data set of 491 Swiss firms that operate internationally and have been surveyed through anonymous standardized telephone interviews. Our findings reveal the need to develop an integrative perspective on CSR, where it is no longer possible to disassociate distinct CSR issues from CSR as an overall umbrella concept for the social responsibility of corporations.
